1. GENERAL
1.1 All bookings made with Victoria Collins either directly or indirectly for any lessons, instruction, coaching sessions, guiding or other activities (hereafter referred to as “Lessons”) and provided by Victoria Collins or other instructors as may be applicable, are subject to the terms and conditions set out here in (the “T&Cs”).

1.2 By making a payment with Victoria Collins, you confirm that you have read and agree to the T&Cs.However you should also be aware that there may be additional terms and conditions specific to your booking.

1.3 By making a booking with Victoria Collins, you confirm that you are the one undertaking any lessons booked, and/or that you have the authority to make a booking for lessons for other people as part of the booking being made, and that all individuals or groups to which the booking applies have read and agree to the terms and conditions here. You should make particular note of the terms relating to insurance and by making a booking whether for yourself or others, that all parties are adequately insured for the Lessons being undertaken.

1.4 For the avoidance of doubt, the terms “You” and “Your” where they relate to the booking or Lessons or the person making the booking, also apply to any other persons who are part of a booking being made.

2. INSURANCE

2.1 It is your responsibility to obtain sufficient insurance cover for all activities which are to be undertaken during your Lessons. If you are booking for someone else’s Lessons then either you or they have responsibility for making sure all those taking Lessons are adequately covered. For the avoidance of doubt Victoria Collins has no responsibility or liability in the event that you have not adequately insured yourself or others receiving Lessons.

2.2 You confirm that at the time of any Lessons you will be adequately insured for all the Lessons you or those booked on the Lessons are undertaking. For the avoidance of doubt this may include skiing and snowboarding (“Snowsport Activities”) in which you will be participating, and this may include but not be limited to piste skiing, off-piste skiing or snowboarding, race or competition training, ski touring, heli-skiing and/or adaptive Snowsports Activities as may be relevant.

3. PAYMENT AND BOOKING

3.1 You will be advised of the total price of any Lesson/s (“Price”) and the payment method at

the time of booking. 

3.2 Please note some payment methods incur surcharges. Please see below.

3.3 If you make a booking greater than 50 days in advance of the date of the first day of your

Lessons (“First Lesson”).

1. Your booking will be held for a maximum of 14 days within which full payment must be made. If there are less than 50 days before the start date of your lesson, full payments are to be paid in full at time of invoice. 
2. If your booking is not fully paid for within the 14 day period above, your booking dates will be released.
3. Part payments for a booking are not accepted unless strictly agreed in writing by Victoria Collins.

3.4 When making a payment please be aware:

• Preferred payment method is SEPA. Otherwise Direct Bank Transfer and BACS can be accepted

• Invoices will be issued in Euros and must be settled in Euros.

• Therefore any BACS or international money transfers which originate in a non-euro denomination must accept all charges for the payment process to complete.

• For the avoidance of doubt, the amount invoiced in Euros must be the amount which clears in Victoria’s Euro account.

3.5 In the event where payments are received but need to be returned, the amount returned will be the invoiced amount minus any fees incurred in returning the payment to you.

3.6 No contract will exist until a receipt is issued accepting your payment.

3.7 Prices are correct as of time of booking.

3.8 Lesson places are not transferable. The lesson/s booked must be taken by the named person unless previously agreed by Victoria Collins.

4. CANCELLATION

4.1 If you cancel your booking more than 50 days before the First Lesson you will be entitled to a 80% refund of any amount paid towards the Price less any charges incurred in returning this money to you.

4.2 If you cancel your booking between 50 days and 30 days before the Lesson Start Date, you will be entitled to a refund of 50% of the amount paid towards the Price less any charges incurred in returning this money to you.

4.3 If you cancel your booking 30 days or less before the Lesson Start Date, you will not be entitled to any refund and will be responsible for payment of the Price in full. It is strongly recommended that you take out cancellation insurance.

4.4 In the event of cancellation or curtailment of your lesson or inability to ski for any reason out-of your ski teachers control (including but not limited to lift or resort closure, weather conditions, road closure, snow conditions, your illness or injury or your non-attendance), you will not be entitled to a refund of the price.

4.5 If your Lesson is cancelled by your Instructor, she will endeavour to arrange for an alternative ski teacher of an equivalent standard to take the Lesson (subject to your prior agreement). Where an alternative ski teacher is not provided, you will be entitled to a full refund of the price (including any Deposit) for the cancelled lesson. For the avoidance of doubt [and pursuant to paragraph 7 below] your Instructor will have no responsibility for any additional costs incurred and you shall not be entitled to compensation or other payment in respect of such additional costs incurred.

5. PUBLICITY MATERIAL

5.1 Photographs and names of clients may be used in publicity material and social media relating to Victoria Collins (TORI.SKI). By making a booking you confirm your consent to any such photographs being used. Please inform Victoria if you do not give consent to any such video or photographs being used for this purpose.

6. STANDARD OF SERVICE

6.1 If you are not completely satisfied with your ski teacher’s service or your Lesson, please let Victoria  know as soon as possible and she will make her best efforts to meet your expectations. If you have any particular needs or requests, you should advise your ski teacher at the start of (or in advance) of your lesson.

6.2 Your ski teacher carefully considers the standards of her clients as well as the conditions to design a programme of lessons, meeting points and ski routes. However these arrangements are subject to change at any time in light of prevailing conditions.

6.3 While you are in the care of your ski teacher you should respect the professional judgements made by them and follow all safety considerations.

6.4 Your ski teacher is a current and full member of the British Association of Ski Instructors (“BASI”) and abides by its policies, regulations and codes of conduct. More information can be found at www.basi.org.uk.

6.5 Your ski teacher also has full French equivalence, a french Carte Professional and full French liability insurance through SIMS www.sims.ski

7. LIABILITY

7.1 Your ski teacher shall not be liable to you for any loss or damage suffered (whether direct or consequential), howsoever caused, as a result of your participation in the lessons to the full extent permissible by law.

7.2 Skiing and Snowboarding like all sports entails risks. The FIS Rules of Conduct’s purpose is to avoid accidents on the piste. This code must be considered an ideal pattern of conduct for a responsible and careful skier or snowboarder. The FIS Rules apply to all skiers and snowboarders and all are obliged to be familiar with and to respect them. Any skier who fails to follow this code, could expose him or herself to civil and criminal liability in the event of an accident. By making a booking you confirm you have read and understand the FIS rules of conduct.

7.3 All participants of the lesson must wear a correctly fitted snowsports specific helmet.

8. DISCLAIMER 

8.1 By making a booking you confirm that you understand that you will be taking part in physical activity in a mountain environment so should satisfy yourself that you and your equipment are in a fit and safe condition for your lesson and for any Snowsport Activities you are taking part in. Please make your ski teacher aware of any injuries or illness which they should be aware of at the start of (or in advance) of your lesson.

9. GOVERNING LAW

9.1 Bookings will be governed by, and construed and interpreted in accordance with Scots Law and the Scottish Courts shall have exclusive jurisdiction to determine any matter arising in relation to these T&Cs or your participation in any Lessons with Victoria Collins.

10. EXCEPTIONAL CIRCUMSTANCES 

10.1 In supporting TORI.SKI skiers this winter season in some uncertain times the following allowances and conditions have been added exclusively for the 2021/2022 winter season

• No deposit is necessary for lessons booked to take place between 1st December 2021 and 30th April 2022 (unless more than 1 ski teacher is booked) 
• Full payment is to be made 6 weeks prior to the first lesson date.

10.2 As stated in the current TORI.SKI conditions 2.1 and 2.2. ‘It is your responsibility to obtain sufficient insurance cover for all activities which are to be undertaken during your Lessons’

It is strongly advised that you have adequate Covid-19 related travel and holiday disruptions and cancellations insurance. 

10.3 In the event that your TORI.SKI booking is disrupted or cancelled due to the following Covid-19 related reasons and this isn’t covered by your Insurance policy, (Evidence may be required) then you are advised to contact Victoria for the possibility to

• Defer lessons to a later date this winter or on to winter 2022/2023 (Depending on availability)
  or
• Receive a full refund

*Deferrals and refunds will be given on a pro-rata basis where some lessons have been taken.

The acceptance of a deferral or refund will occur in ONLY the following circumstances, concerning the effects of Covid-19 ONLY.

1. a) There are travel restrictions to France from your country of origin, following FCO giving advice against all but essential travel to France over the period of your lesson dates.
2. b) There are travel restrictions within France following government orders over the period of your proposed lesson dates.
3. c) Closure of the Tignes and Val d’Isere ski area due to national or local lockdown laws over the period of your lesson dates.

10.4 Any financial recompense or compensation sought due to disinclination to travel, for personal health, family health or quarantine reasons, or where there are no lockdown restrictions, nor travel restrictions, would need to be obtained through your own insurer and insurance policy.

FIS Rules of Conduct

1. Respect for others

A ski­er or snow­board­er must be­have in such a way that he or she does not en­dan­ger or prej­u­dice others.

2. Con­trol of speed and ski­ing or snow­board­ing

Ev­ery ski­er or snow­board­er must move in con­trol. He must adapt the speed and man­n­er of ski­ing or snow­board­ing to his per­so­n­al abil­i­ty and to the pre­vail­ing con­di­tions of ter­rain, snow and weather as well as to the den­si­ty of traff­ic.

3. Choice of route

A ski­er or snow­board­er com­ing from be­hind must choose his route in such a way not to en­dan­ger skiers or snow­board­ers ahead

4. Overtaking

A ski­er or snow­board­er may over­take another ski­er or snow­board­er above or be­low and to the right or to the left pro­vid­ed that he leaves enough space for the over­tak­en ski­er or snow­board­er to make any vol­un­tary or in­vol­un­tary move­ment.

5. En­ter­ing, start­ing and mov­ing up­wards

A skier or snowboarder en­ter­ing a marked run, start­ing again af­ter stop­ping or mov­ing up­wards on the slopes must look up and down the slopes that he can do so without en­dan­gering himself or others.

6. Stopping

Un­less ab­so­lute­ly ne­ces­sary, a skier or snow­board­er must avoid stop­ping on the piste in nar­row places or where vis­i­bil­i­ty is re­strict­ed. After a fall in such a place, a skier or snowboarder must move and clear the slope as soon as pos­si­ble.

7. Climb­ing and de­s­cend­ing on foot 

A ski­er or snow­board­er ei­ther climb­ing or de­s­cend­ing on foot must keep to the side of the slope.

8. Re­spect for signs and markings

Skiers and snow­board­ers must re­spect all signs and mark­ings.

9. Assistance

At accidents, ev­ery ski­er or snow­board­er is du­ty bound to as­sist.

10. Identification

Every skier or snowboarder and witness, whether a responsible party or not, must exchange names and ad­dress­es following an accident.

Accidents

Assisting in case of an accident

• Secure the accident area.
• Protect with crossed skis or planted snowboard above the injured person. If necessary post someone up the slope to give warning.

First Aid

• Airway – check it is clear
• Breathing – check for breathing
• Circulation –  cover any wound and apply firm pressure
• Provide warmth – give nothing to eat or drink, especially alcohol

Alert the rescue services

• Contact the resort’s emergency service – the telephone number is normally on the piste map
• Place of accident (piste name and nearest piste marker)
• Number of people injured
• Type of injury

Establish the facts of the accident

• Names and addresses of people involved as well as witnesses
• Place, time and circumstances of accident
• Terrain, snow conditions and visibility
• Markings and signs
• Report to the police as soon as possible
